OF MOHAVE COUNTY �� CAROL MEIER, COUNTY RECORDER -0041 � 10/19/2012 02:04 PM Fee: $0.0 PAGE: 1 of 2 MOHAVE COUNTY ORDINANCE NO. 2012-05 AN ORDINANCE TO AMEND THE MOHAVE COUNTY ZONING ORDINANCE, SECTION 9 AND SECTION 20, TO PROVIDE FOR LEARNING CENTERS IN COMMERCIAL ZONES. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on October 15, 2012, a public hearing was conducted to determine whether approval should be granted to amend the Mohave County Zoning Ordinance, Section 9 and Section 20, to provide for Learning Centers in Commercial Zones, as requested by the Mohave County Development Services Department, and WHEREAS, this request by Mohave County is to amend the Mohave County Zoning Ordinance to define the term "Learning Centers" and recognize those centers as an allowed use in commercial zones, and WHEREAS, the Mohave County Zoning Ordinance does not recognize centers that provide tutoring or supplemental education as a defined land use. While these centers could be allowed in commercial zones as a general service, the absence of a direct reference leaves the Ordinance up to interpretation. By including the definition in Section 9 of the Ordinance, and specifying the allowable zones, the status of learning centers is clear for the Department and its customers, and WHEREAS, Section 20 is the Neighborhood Commercial (C-1) zone. Commercial-Office- Residential (COR), General Commercial (C-2) and General Commercial-Highway Frontage (C-2H) zones each state that included in the allowable uses in that zone are all of the uses allowed in the preceding zone. The uses allowed in C-1 are allowed in COR and C-2; the uses allowed in C-2 are allowed in C-2H. By including"Learning Centers"in C-1, those centers would also be allowed in COR, C-2 and C-2H, and WHEREAS, proposed new language is bolded and double underlined. The remaining language is unchanged, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on September 12, 2012, the Commission recommended APPROVAL for this Ordinance, and WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, on September 30, 2012, and was posted on September 28, 2012, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. ORDINANCE NO. 2012-05 PAGE 2 NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, October 15, 2012, APPROVED this Ordinance amending the Mohave County Zoning Ordinance as recommended by the Mohave County Planning and Zoning Commission as follows: 1. In Section 9, Definitions, of the Mohave County Zoning Ordinance insert "Learning Centers"between the terms "Launderette" and "Legal Access" as follows: Learning Center: A location that provides academic testing services, tutoring and/or supplemental academic education, not to include schooling for grades K-12, as defined by this Ordinance. 2. In Section 20, Neighborhood Commercial, of the Mohave County Zoning Ordinance, revise as follows: B. Uses Permitted. 3. Bakeries, retail, barber shops, beauty shops, book stores, cleaners or laundry collecting and distributing facilities, confectionery stores, delicatessens, dressmaking shops, drug stores, dry goods, electric appliances, florists, food markets, grocery stores,jewelry stores, learning centers, meat markets, millinery shops, offices, photographic studios, shoe sales and repairs, stationery stores, tailor shops, and variety and notions, and other uses of similar description and accessory structures related to and necessary for the operations of the primary use.
