HomeMy WebLinkAbout2013-03 I Ill FEE# 20140 622 OFFICIAL RECORDS "Of/ OF MOHAVE COUNTY I CAROL MEIER, 1r COUNTY RECORDER ANSPre tug 03/24/2014 02:38 PM Fee: $0.00 PAGE: 1 of 3 MOHAVE COUNTY ORDINANCE NO. 2013-03 Mohave County Pawn Reporting Ordinance AN ORDINANCE OF THE MOHAVE COUNTY BOARD OF SUPERVISORS ESTABLISHING REQUIREMENTS FOR REPORTABLE PAWN TRANSACTIONS AND PAYMENT OF RELATED FEES PURSUANT TO ARIZONA REVISED STATUTES SECTION 44-1625 WHEREAS, Arizona Revised Statute (A.R.S.) § 44-1625 mandates that a pawnbroker submit a true, complete and accurate report each day of each item received through a reportable transaction; and WHEREAS, the mandated report is required to be delivered within two (2) business days of the transaction, by mail, hand delivery or electronic means approved by the sheriff; and WHEREAS, the mandated report must be made on a form provided by, or approved by the sheriff; and WHEREAS, that on May 20, 2013 the Mohave County Board of Supervisors adopted Resolution 2013-025, establishing a reportable transaction fee to be paid by a pawnbroker on each initial reportable transaction(not on extensions) of Forty Cents ($.40); and WHEREAS, the purpose of this ordinance is to adopt the Mohave County Sheriff's reporting requirements for reportable pawn transactions pursuant to A.R.S. § 44-1625; and NOW THEREFORE BE IT RESOLVED, that the Mohave County Board of Supervisors hereby adopts the following ordinance establishing uniform definitions and requirements for the reporting of pawn transactions and payment of related service fees by licensed pawn brokers with in Mohave County: Section I—Title This ordinance shall be cited as the "Mohave County Pawn Reporting Ordinance." Section II—Applicability This ordinance shall apply to all pawnbrokers within the geographic boundaries of Mohave County, Arizona, licensed by the Mohave County Sheriff pursuant to A.R.S. § 44-1627 MOHAVE COUNTY ORDINANCE 2013-03 Page 2 Section III—Transaction to be Reported Electronically All transactions required to be reported pursuant to A.R.S. §44-1625 shall be reported electronically using the "LeadsOnLine", or successor electronic service as specified by the Mohave County Sheriff. In addition to the information required by A.R.S.§44-1625, each report shall include electronic fingerprints of the pawn customer. Section IV—Payment of Reporting Fees Required In addition to fees required under A.R.S. §44-1629 for licensing, each pawnbroker shall pay a reporting fee, as set, or amended, by the Mohave County Board of Supervisors. Reporting fees payable for initial reportable transactions during a calendar month shall be paid to the Sheriff no later than 5 p.m. on the 28th day of the succeeding calendar month. Payment of all fees payable for the calendar month shall be made by a single check, or money order made payable to the Mohave County Sheriff's Office. Box 1191 Kingman, AZ 86402 Section V—Violation and Penalties In addition to any other penalties specified in Title 44, Chapter 11, Article 3 of the Arizona Revised Statutes, a violation of any provision of this ordinance (including without limitation a failure to report or to timely report a reportable transaction, a failure to report information required by A.R.S. § 44-1625 or this ordinance, or a failure to pay or to timely pay fees payable under Resolution No. 2013-025 or this ordinance) shall be grounds for suspension of the pawnbroker's license pursuant to A.R.S. § 44-1628. Section VI—Enforcement Enforcement of this ordinance shall be by the Mohave County Sheriff's Office in accordance with Arizona statutes, codes, and regulations, and any revisions or amendments thereto. Section VII—Severance Clause If any section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be invalid or unconstitutional, such provision shall not affect the validity of the remaining portions of the ordinance. The County Board of Supervisors hereby declares that they would have passed this ordinance in each section, subsection, sentence, clause or phrase thereof MOHAVE COUNTY ORDINANCE 2013-03 Page 3 irrespective of the fact that any one or more such sections, subsections, sentences, clauses or phrases be declared invalid or unconstitutional.
