WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on July 1, 2013 a public hearing was conducted to determine whether approval should be granted to amend the Mohave County Zoning Ordinance to amend Section 9, Definitions, to eliminate the limitation on the duration of a rental or lease as requested by the Mohave County Development Services Department, and WHEREAS, the definition of "Manufactured Home Park" in the Mohave County Zoning Ordinance currently contains a limitation on the duration of a rental or lease to no more than 364 days. This limitation was originally included to prevent a conflict with a limitation then contained in state statutes regarding creation of a subdivision. Arizona Revised Statutes now specifically exempt rental or lease of spaces in manufactured home parks from the definition of "Subdivision" under Section 32- 2101.56(c)(111). The language proposed to be eliminated is no longer necessary and is unnecessarily restrictive, and WHEREAS, proposed new language to be deleted has been s#mek. The plain text is existing I anguage that is not proposed to be changed, and is provided for contextual reference, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on June 12, 2013, the Commission recommended APPROVAL for this Ordinance, and WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, on June 16, 2013, and was posted on June 14, 2013, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, July 1, 2013, APPROVED this Ordinance as recommended by the Mohave County Planning and Zoning Commission and outlined herein. ORDINANCE NO. 2013 -06 PAGE 2 Amend Section 9, Definitions, of the Mohave County Zoning Ordinance as follows: Manufactured Home Park A parcel of land, under single ownership which has been planned and improved for the placement of manufactured homes for non - transient residential use.
