HomeMy WebLinkAbout200 (2) 549 Office of the Board of Super-visors Mohave County, KinFman Arizona October 16, 1957 S(pction 8. CONFLICTING ORDINANCES, ORDERS, RULES AND REGULATIONS, SUSPENDED. At all times when the orders, rules and regulations made and promulgated pursuant to this ordinance shall be in effect, they shall supersede all existing ordinances, orders, rules and regulations insofar as the latter may be in- 1: consistent therewith. Section 9. NO CONFLICT I-MH STATE CR FEDERAL STATUTES. This ordinance shall not be construed 1� as to conflict with any State or Federal Statute or with Military or Naval order, rule or regulations. Section 10. NO K-THICIPAL OP. PRIVATE LIABILITY. This ordinance is an exercise by Mohave County of its governmental functions for the protection of the public peace, health and safety and neither Mohave County, the agents and representatives of said County, nor any individual, receiver, firm partner ship, corporation, association, or trustee, nor any of the agents thereof, in good faith carrying out, complying with or attempting to comply *ith, any order, rule or regulations promulgated pursuant to the provisions of this ordinance shall be liable f., any damage sustained to p, rs.n or property as the result it o said activity.. Any person owning or controlling real estate or other premises who voluntarily and without compensation grants to Vohave County a license or privilege, or otherwise permits the County to inspect, as p nspect, designate and use the whole or any part or parts of such real estate or pr emis for the ur po as of sheltering persons during an actual, impending or practice enemy attack shall, together with his sucessors in interest, if any, be not civilly liable for the death of, or injury to, any person on or about such real estate or premises under such license, privilege or other permission or for loss of, or damage to, the property of such person. Section 11, EXPFNSFZ OF CIVIL DEFENSE. No person shall have the right to expend any public funds of the County in carrying out any civil defense activity authorized by this ordinance without prior and specific approval of the Board of Supervisors. Except that the Board of Supervisors may budget money for civil defense activities under this ordinance and such funds shall be spent at the direction of the Director and with the approval of the Board of SuFervisors. i� S ection 12. VIOLATIONS. It shall be unlawful for any person willfully to obstruct, hinder or delay any member of the civil defense organization in the enforcement of any rule or regulation is sued pursuant to this ordinance, or to do any act forbidden by any rule or regulation issued pursuant to the authority contained in this ordinance. Convictions for violations of thc i ions of this ordinance a shall be punishable by a fine not to exceed three hundred dollars (0300. or by imprisonment in the County jail for six (6) months, or both. it Section 13. SEVERABILITY. If any portion of this ordinance shall, for any reason, be declared invalid, such invalidity shall not effect the remaining provisions hereof. Section 14. WHEREAS, the immediate operation of the provisions of this ordinance is nec for the preservation of the public :peace, health and safety, an EMERGENCY is hereby declared to exis and this ordinance shall be in full force and effect from and after its pas by the Board APPROVED this 16th day of October, 1957• Board I. BE IT RESOLVTM by the Board of Supervisors of Mohave County, Arizona: WHEREAS, for the protection of the public peace, health and safety Ordinance #200, creating a Civil Defense Organization defining the powers and duties of the Civil Defense Board and Director and declaring an emergency, shall be adopted and approved.
