A RESOLUTION SETTING FORTH A REZONING OF PARCEL 39, SUNWARD HO!
RANCHES, ZAFIRO ACRES, FROM A -R /10A (AGRICULTURAL- RESIDENTIAL %TEN
ACRE MINIMUM LOT SIZE) ZONE, PROPOSED TO BE A -R/5A (AGRICULTURAL -
RESIDENTIAL/FIVE ACRE MINIMUM LOT SIZE) ZONE, IN SECTION 5,
TOWNSHIP 22 NORTH, RANGE 16 WEST, LOCATED APPROXIMATELY ONE -HALF
(. 5 ) MILE EAST OF NORTH BANK STREET AND DIRECTLY SOUTH OF CALLE
ALAMO IN THE LONG MOUNTAIN PORTION OF THE MOHAVE COUNTY GENERAL
AREA.
WHEREAS, at the regular meeting of the Mohave County Board
of Supervisors held on August 2, 1993, a public hearing was
conducted to determine whether approval should be granted to SMK
Limited Partnership, General Partner Roger Sayles, of Kingman, AZ
for a zone change from A -R /10A (Agricultural - Residential /Ten Acre
Minimum Lot Size) zone to A -R /5A (Agricultural - Residential /Five
Acre Minimum Lot Size) zone in the Long Mountain area, and
WHEREAS, the subject property is within the Long Mountain
Area Plan. It is located in the northeast quarter of Section 5,
approximately three and one -half miles north of Jagerson Street.
Parcel 39 is accessed from Jagerson to North Bank Street
approximately three and one -half miles north, thence east on
Calle Alamo approximately one -half mile to the northwest corner
of the subject property.
WHEREAS, electric is the only existing utility. There are
two residences within an approximate one -half mile radius; the
remaining land in the vicinity and the subject property are
vacant. Site topography is relatively flat with typical desert
vegetation.
WHEREAS, Floodplain Map #040058 -2155C indicates this parcel
is within a zone "C" designation, an area of minimal flooding.
WHEREAS, the applicant desires this 16.6 -acre parcel to be
split into three 5 -plus acre parcels. Site access is off Calle
Alamo, an east -west arterial for the Long Mountain area, via a
proposed 30 -foot private road and utility easement along the
western property line of the two most northern proposed parcels.
WHEREAS, this rezone is in conformance with the Long
Mountain Area Plan.

WHEREAS, at the public hearing before the Mohave County
Planning and Zoning Commission on July 14, 1993, the Commission
recommended APPROVAL of the zone change and resultant lot split
contingent on the following:
1. The three parcels be zoned A -R /5A (Agricultural -
Residential /Five Acre Minimum Lot Size).
2. Submittal and recordation of a Parcel Plat prepared in
accordance with Article 3.16 of the Mohave County
Subdivision Regulations.
3. The three parcels will meet or exceed five acres
exclusive of road easements or rights -of -way.
4. Each parcel shall have legal access.
5. The Parcel Plat shall show any surface drainage and
FEMA flood zones.
6.
That appropriate zoning /building /environmental permits
be obtained prior to any development. These permits
will not be issued until Parcel Plat recordation.

The granting of a 30 -foot ingress /egress and public
utility easement along the east side of the proposed
two most northern parcels. This shall be approved
through the recording of the resolution authorizing the
zone change, and that the granting be shown via an
acceptance statement and identified on the Parcel Plat.

The rezone shall not become effective for 30 days after
final Board of Supervisors approval for the change in
classification, as per ARS 11 -829E.

If these conditions are not met within one year this
approval will be void. If at the expiration of this
period the property has not been improved to meet the
use for which it was conditionally approved, the Board
(after notification by registered mail to the owner and
applicant who requested the rezoning) shall schedule a
public hearing to: grant an extension, determine
compliance with the schedule for development or cause
the property to revert to its former zoning
classification. This action is in accordance with
Arizona Revised Statutes Annotated, Title 11, Chapter
6, 11 -832.

WHEREAS, the notice of hearing was published in the Kingman
Standard, a newspaper of general circulation in Kingman, Mohave
County, Arizona, June 26, 1993, and posted July 16, 1993 as
required by Arizona Revised Statutes, and the Mohave County
Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors,
at their regular meeting on Monday, August 2, 1993, approved this
zone change as recommended by the Mohave County Planning and
Zoning Commission and outlined herein.
