PAGE 1 OF 3 MOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0,00 we RESOLUTION NO. 93 -234 A RESOLUTION SETTING FORTH A REZONING OF PARCEL 1 IN LAZY Y -U RANCH, PHASE I FROM A -R /36A ( AGRICULTURAL - RESIDENTIAL /THIRTY -SIX ACRE MINIMUM LOT SIZE) ZONE, PROPOSED TO BE A -R /15A AND 8A ( AGRICULTURAL - RESIDENTIAL /FIFTEEN ACRE AND EIGHT ACRE MINIMUM LOT SIZE) ZONE, IN SECTION 3, TOWNSHIP 20 NORTH, RANGE 16 WEST, LOCATED IN THE MOHAVE COUNTY GENERAL AREA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on- August 2, 1993, a public hearing was conducted to determine whether approval should be granted to Melvin and Betty Klein of Richville, MN for a zone change from A- R/36A ( Agricultural - Residential /Thirty -six Acre Minimum Lot Size) zone to A -R /15A and A -R /8A (Agricultural- Residential /Fifteen and Eight Acre Minimum Lot Size) zones in the Mohave County general area, and WHEREAS, the subject property is located approximately four miles southeast of the Kingman City Limits, off Hualapai Mountain Road. The subject property is located in the northwestern corner of Lazy Y -U Ranch, Phase I. Access is from Hualapai Mountain Road to Lazy Y -U Drive southwesterly, then northwesterly approximately three and one -half miles, thence northwesterly on Buckskin Lane approximately one - quarter mile to the southern boundary of the subject property. WHEREAS, the property directly north of Parcel 1 is owned by the Bureau of Land Management. BLM has requested "that any properties adjacent to public land be adequately marked to prevent possible future encroachment and subsequent trespass actions." The western contiguous land is planned by the developer as Phase II of the Lazy Y -U Ranch. WHEREAS, currently the subject property and surrounding properties are vacant. There are no public utilities serving this site. The site terrain is comprised of hills and valleys. WHEREAS, Floodplain Map #040058 -2350B indicates this parcel is within a zone "C" designation, an area of minimal flooding, which does not require a permit. WHEREAS the subject property is not within the Building Overlay Zone, or under a designated area plan. 4 • s.* • • RESOLUTION NO. 93 -234 Page 2 WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on July 14, 1993, the Commission recommended APPROVAL of the zone change and resultant lot split contingent on the following: 1. The northernmost parcel be zoned A -R /15A (Agricultural - Residential /Fifteen Acre Minimum Lot Size) and the two southern parcels be zoned A -R /8A (Agricultural - Residential /Eight Acre Minimum Lot Size). 2. Submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations. 3. As assigned in condition number one, the three parcels will meet or exceed their designated acreage exclusive of road easements or rights -of -way. 4. Each parcel shall have legal access. 5. The Parcel Plat shall show any surface drainage and r� FEMA flood zones. 6. That appropriate zoning /building /environmental permits be obtained prior to any development. These permits will not be issued until Parcel Plat recordation. 7. The rezone shall not become effective for 30 days after final Board of Supervisors approval for the change in classification, as per ARS 11 -829E. 8. If these conditions are not met within one year this approval will be void. If at the expiration of this period the property has not been improved to meet the use for which it was conditionally approved, the Board (after notification by registered mail to the owner and applicant who requested the rezoning) shall schedule a public hearing to: grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification. This action is in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11 -832. WHEREAS, the notice of hearing was published in the Kingman Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, June 26, 1993, and posted July 16, 1993 as required by Arizona Revised Statutes, and the Mohave County Zoning Regulations. PAGE 2 OF 3 3K 2261 PG 637 (FEEi93- 44061) < f RESOLUTION NO. 93 -234 Page 3 NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, August 2, 1993, approved this zone change as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
