SUMMARIZE THE ISSUE & DESIRED ACTION CLEARLY/ATTACH BACKUP MATERIAL:
ACTION: Formal acceptance of Mohave County of portions of granted Roadway and Public Utility
Easement on Record of Survey Book 34 page 56, original segregation of Parcel 6 Cedar
Hill Ranches, Unit 4.
LOCATION: Site is located in the Blake Ranch area north of 1-40 and 1-93 interchange off of Prospector
Drive. To access take Round Valley Road north off of 1-40 and 1-93 interchange to inter
section with Summerson Road. Go Summerson Road north which will merge into Blake
Ranch Road heading a westerly direction continuing on until intersection with Prospector
Drive to the north. Go Prospector Drive to the portions of granted roadway to the
northeasterly direction or property APN 354-40-006D, 006C, 006B in Blake Ranch area,
county of Mohave, state of Arizona.
PETITIONER:.... Vivian Gerber owner of APN 354-40-006B (Parcel 6B Record of Survey).
DIMENSIONS: ... Granted Roadway and Public Utility Easement as shown on Record of Survey is 1,724
feet long by 30 feet wide.
ATTACHMENTS:...Acceptance Statement (for recording), Record of Survey Book 34 page 56, Vivian
Gerber letter.
Recommended Motion: Move to formally accept the granted Roadway and Public Utility Easement for
a section of Prospector Drive measuring 1,724 feet long by 30 feet wide in the Blake Ranch area and as
offered on "Record of Survey Book 34 page 56" recorded February 21, 2005 under the Mohave County
Recorder's reception number 2007015445 and authorize the Clerk of the Board to sign and record the
formal acceptance statement on behalf of the Board of Supervisors.

ACCEPTANCE FOR ROAD RIGHTS-OF-WAY AND PUBLIC UTILITY EASEMENT
On February 21, 2007 a Record of Survey was filed in the office of the Mohave County
Recorder under reception No. 2007015445, Book 34, page 56 whereas no formal Board of
Supervisors statement was arranged to accept owner Wayne Downs offer of a 30 foot wide by
1,724 foot long, more or less, Roadway and Public Utility Easement (PUE).
Therefore be it known to all men present that:

purposes including public use, the forgoing described Property conveyed for the purposes
stated. This acceptance is not a representation or commitment by the County that it will at any
particular date or time construct, establish or maintain any improvement, including any roadway

Dear Mr. Foose,R.L.S.
Im addressing this letter to you in reference to your letter, dated March
17th 2015, and I'm enclosing the attach map referecing the road issue as
stated in previous letters addressed to you. You stated that this map has
not been addressed by the board of supervisors for approval, and that the
map was not processed under Mohave County Land Regulations, which
addresses dedication and acceptance. It appears that common law
dedications remain viable in the state of Arizona, and that the dedication in
this issue meets the common law of roadway easements for public use.
Wayne Downs, as stated in the map has granted this roadway to the county
for public use, my question is, as you stated that, this map has not been
accepted. Who, I'm the new owner of said property, not the easement in
this matter, who has to address this map to be approved or accepted? First
American Title holds record of survey, Mohave County named the
easement E. Prospect Rd. Question? dedication of this roadway by Wayne
Downs for public use, has this dedication been accepted. Has this
dedication of private land to public use , actually been used by the general
public before it was effectively dedicated to public use. According to this
map Wayne Downs recorded this plat containing a dedication , coupled
with the sale of property,doesn't that constitutes an acceptance by
perscription? So, who is the dedicater of this roadway easement and does

the financial burden of repair fall on them.
Im enclosing the map for review and would like to hear a response to my
questions by mail. Im trying to resolve this matter, Im transversing over
private property to access my property, I'm unable to now not have any
water deleivered , because there is no access, no road, Im asking for your
help on how I can resolve this matter, Cedar Hills Ranches.
